Justice Alito has ordered Texas to respond to the emergency application in the HB20 / social media platform moderation case by Wednesday at 5 p.m. EDT. That’s not as fast as I would’ve expected, but it’s still faster than if he was signaling a lack of concern:

When there’s no majority opinion, the “Marks rule” provides that the narrowest oli on supporting the majority’s *judgment* controls. So if it’s 4-1-4, and the 1 is to uphold the Mississippi law without formally overruling Roe and Casey, that opinion would technically control.

At Conference today, the Chief will place two justices in separate offices. If one justice confesses but the other does not, the confessor goes free and the other gets 20 ERISA opinions. If both confess, each gets 5 ERISA opinions. If neither confess, each gets 1 ERISA opinion.

This is huge, in part, because it will allow the Commission to resolve major Guidelines circuit splits. #SCOTUS doesn't step into Guidelines splits anymore, and Justices Sotomayor and Barrett teamed up on a statement earlier encouraging a quorum at the Commission.
The White House is advancing a bipartisan slate of nominees for the U.S. Sentencing Commission, including Mississippi District Court Judge Carlton Reeves, who'd be the first Black person to serve as chairman. The panel has lacked enough members to do its job for three years.
